1. Acceptance of Terms

These Terms of Service (“Terms”) are a binding agreement between you and elephantmilk asia LLC (“we,” “us,” or “our”) governing your access to and use of the Pinnacle Pulse website, mobile application, and related services (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use the Service.

2. Description of Service

Pinnacle Pulse is a peptide protocol tracking and body visualization platform that may include:

• Peptide logging (substance, dose, injection site, protocol combinations)
• Multi-angle body scanning and 3D avatar generation
• AI-powered forecasting (e.g., recovery, muscle, energy, focus) via on-device machine learning (EvoEngine)
• 3D morph visualization and AR body viewer
• Integration with wearables (e.g., Xiaomi Smart Band 10, HUAWEI Band 10) for HRV, sleep, steps, SpO₂
• Optional blood panel integration with partner laboratories (Pro tier)

We may add, change, or discontinue features at any time. The Service is provided for personal, non-commercial use to track and visualize your own data and is not a medical device or substitute for professional medical advice.

3. Eligibility

You must be at least 18 years of age and have the legal capacity to enter into a binding agreement to use the Service. By using the Service, you represent that you meet these requirements. The Service is not intended for use in any jurisdiction where offering or using it would be illegal.

4. Account Registration

When you create an account or join the waitlist, you agree to provide accurate, current, and complete information and to update it as needed. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

5. Subscription Plans and Payments

Pinnacle Pulse may offer free and paid subscription tiers, including but not limited to:

• Free: Core tracking and on-device features as described at the time of sign-up
• AR: Additional AR and sharing features (e.g., $7.99/month, or equivalent local currency)
• Pro: Advanced features including blood panel integration (e.g., $18.99/month, or equivalent)

Pricing, billing frequency, and feature availability are subject to change with notice. Subscriptions may auto-renew unless cancelled before the renewal date. Refunds are handled in accordance with the platform (e.g., App Store, Google Play) or our stated refund policy at the time of purchase. We do not guarantee refunds for partial periods or unused portions of a subscription.

6. User Responsibilities

You agree to:

• Use the Service only for lawful purposes and in accordance with these Terms
• Provide accurate data when logging peptides, biometrics, or other health-related information
• Comply with all applicable laws in your jurisdiction, including those governing peptides, supplements, and health data
• Not misuse the Service to harm others, circumvent security, or violate any third-party rights

7. Health and Medical Disclaimer

The Service is for informational and personal tracking purposes only. It is not a medical device, does not provide medical advice, diagnosis, or treatment, and is not a substitute for consultation with a licensed healthcare provider. You should always seek the advice of a physician or other qualified health provider regarding any health condition, peptide use, or treatment. Do not disregard professional medical advice or delay seeking it because of anything in the Service. In case of a medical emergency, contact emergency services immediately.

8. Intellectual Property

All content, software, algorithms, AI models, 3D assets, designs, logos, and materials provided through the Service are owned by elephantmilk asia LLC or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, reverse engineer, or create derivative works from the Service or any part of it except as expressly permitted by us or by applicable law.

9. User Content

You retain ownership of the data you input (e.g., logs, body scan images, biometric entries). By using the Service, you grant us a limited, non-exclusive, royalty-free license to use, process, store, and display that data solely to provide and improve the Service, in accordance with our Privacy Policy. We do not claim ownership of your personal health data.

10. Prohibited Conduct

You may not:

• Reverse engineer, decompile, or attempt to extract source code or models from the Service
• Scrape, crawl, or use automated means to access the Service without our permission
• Gain unauthorized access to our systems, other users’ accounts, or any data not intended for you
• Use the Service to distribute malware, spam, or illegal content
• Resell, sublicense, or commercially exploit the Service except as expressly allowed

11. Third-Party Services

The Service may integrate with third-party products (e.g., wearables, laboratories). Those services are subject to their own terms and privacy policies. We are not responsible for the availability, accuracy, or practices of third parties. Your use of wearable or lab integrations is at your own risk.

12. Limitation of Liability

To the fullest extent permitted by law, the Service is provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that predictions or visualizations are accurate or medically valid. In no event shall elephantmilk asia LLC, its affiliates, or its suppliers be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or goodwill, arising out of or related to your use of the Service, even if we have been advised of the possibility of such damages. Our total liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or one hundred U.S. dollars ($100), whichever is greater.

13. Indemnification

You agree to indemnify, defend, and hold harmless elephantmilk asia LLC and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any third-party rights or applicable law.

14. Termination

We may suspend or terminate your access to the Service at any time, with or without cause or notice, including for violation of these Terms. Upon termination, your right to use the Service ceases. Provisions that by their nature should survive (including intellectual property, disclaimers, limitation of liability, and indemnification) will survive termination.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in Delaware, unless otherwise required by mandatory law in your jurisdiction.

16. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy and any other policies we reference, constitute the entire agreement between you and elephantmilk asia LLC regarding the Service and supersede any prior agreements or understandings.
